Vacation Legal Checklist: 4 Must-Have Documents Before You Travel
Estimated Reading Time: 4-5 Minutes

Heading out of town? Make sure your family is legally protected with this quick pre-vacation legal checklist.
Vacation Ready Starts with Estate Ready
A vacation should bring peace, not panic.
But if something unexpected happens while you're away, does your family know what to do?
Estate planning isn’t just for later in life. It’s for anyone who loves someone or owns something—and it’s especially important before you travel.
As your Personal Family Lawyer®, I help families set up legal protections that cover medical emergencies, financial decisions, and guardianship for kids. It only takes a few key steps to make sure your family is covered while you’re away—and long after.
Here’s what to do before you leave:
Create Powers of Attorney
If you're in an accident or become ill while traveling, who can legally step in?
- A Healthcare Power of Attorney gives someone you trust the authority to make medical decisions on your behalf.
- A Financial Power of Attorney lets someone manage bills, bank accounts, and urgent financial matters if you’re unavailable or incapacitated.
Without these, your loved ones may need court approval—delaying critical decisions. Estate planning gives them the power to help you without red tape.
Name a Permanent Guardian for Your Kids
If you have minor children, this is essential.
- A Permanent Guardian is the person you legally name to care for your children if something happens to you.
- Without this in writing, a judge decides who steps in—and it may not be who you’d choose.
Estate planning gives you the final say. It protects your children from uncertainty and gives you control over who raises them if you're gone.
Appoint Short-Term Guardians
Emergencies happen quickly—and your Permanent Guardian might be far away.
- A Short-Term Guardian can step in immediately in an emergency.
- This could be a relative, neighbor, nanny, or anyone local who you trust with your child.
Also give these guardians Medical Power of Attorney for your kids. That way, they can get emergency care without legal barriers.
These small steps can prevent your kids from being taken into state custody, even for a few hours.
Share Your Plan
Even the best estate plan won’t help if no one knows about it.
Before you leave:
- Share your travel details and key legal info with your guardians, family, and close friends.
- Let them know how to access your documents—or how to contact me for copies.
- Make sure someone you trust can step in if needed.
Good communication is part of good planning.
