Florida Estate Plans: Why You Must Review Yours Every 3 Years

Estimated Reading Time: 6-7 Minutes

Why You Must Keep Your Estate Plan Updated

Estate planning isn’t a one-time task. It’s an ongoing process that should reflect your current assets, wishes, family structure, and Florida laws. Whether you’ve had a major life event or not, outdated estate documents can lead to confusion, delays, and unnecessary legal or tax consequences.

What’s at Risk If You Don’t Update

Your Estate Plan?

1. Your wishes might not be followed.
New marriage? Divorce? Birth of a child or grandchild?
If your will, trust, or beneficiary designations don’t reflect these changes, Florida law could override your true intentions. That can lead to family conflict and unwanted outcomes during probate.

2. Your loved ones could face unexpected taxes.
Estate and inheritance taxes may shift with federal or state law updates. Without smart tax planning, your beneficiaries could lose a portion of their inheritance.
Property in multiple states? Business ownership? These add layers of tax and legal complexity.

3. Medical decisions may be unclear during an emergency.
Advance directives, powers of attorney, and HIPAA authorizations need regular reviews.
If you become incapacitated, outdated documents could prevent the right person from making healthcare or financial decisions for you.

4. You may miss chances to build your legacy.
Want to support a charity, leave assets to a non-relative, or protect a family-owned business?
Your estate plan must be updated to clearly document these intentions and ensure they’re carried out legally.

When Should You Review

Your Estate Plan?

Ask yourself:

  • Have I bought or sold property?
  • Has my marital status changed?
  • Have my children grown up or had children of their own?
  • Has the law changed in Florida or federally?
  • Do I want to include a charity or update a beneficiary?

If the answer is yes to any of the above — it’s time to revisit your plan.
